Terms of Service

1. Acceptance of Terms

By accessing or using the Ekewaka GENIE platform at ekewakagenie.com ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

2. Description of Service

Ekewaka GENIE LLC ("Company," "we," "us," or "our") provides an AI-powered field service management platform for contractors, including tools for quote generation, contract management, job scheduling, crew management, and client communication.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Platform. By using the Platform, you represent that you meet these requirements.

4. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your login credentials
  • You may not share your account credentials with others
  • One active session is permitted per account at a time
  • You must notify us immediately of any unauthorized use of your account at hello@ekewakagenie.com

5. Subscription Plans and Billing

Plans: Ekewaka GENIE offers four subscription tiers:

  • 🚀 Pilot — $250/month: 1 contractor. Includes a 3-day free trial, after which the $250/month rate begins. Limited to 25 quotes maximum and 60 days maximum duration (whichever limit is reached first ends the Pilot). $0 setup fee.
  • ⚡ Pro — $497/month: 1 contractor with the full AI suite and unlimited quotes. Includes a 7-day free trial; no annual contract. $97 one-time setup fee, charged after the trial ends along with the first month's payment. Setup fee waived for Pilot contractors upgrading before August 31, 2026.
  • 👥 Team — $1,999/month: Up to 5 contractors included at a flat monthly rate. Includes a 7-day free trial; no annual contract. $497 one-time setup fee, charged after the trial ends along with the first month's payment.
  • 📋 Enterprise — Custom pricing: 6 or more contractors, custom integrations and SLA. Six-month minimum contract. Enterprise plans are not eligible for a free trial.

Trial Terms: A valid payment method is required to start any trial. $0 is due at signup. For Pro and Team, the one-time setup fee is charged after the trial period ends, combined with your first monthly payment. For signups through August 31, 2026 (11:59 PM ET), setup fees are waived entirely.

Billing: Subscriptions are billed monthly. All fees are non-refundable except as required by law. No refund will be issued for the $250 Pilot payment under any circumstances.

Cancellation by plan:

  • Pilot: Cancel anytime. Service ends immediately upon cancellation. No 30-day written notice is required. The $250 already paid is non-refundable.
  • Pro and Team: A 30-day written notice is required. Service continues through the notice period. No refunds will be issued for the current billing period.
  • Enterprise: Subject to a 6-month minimum contract and the cancellation terms negotiated in your contract.

Data Retention: After cancellation, your account data is preserved for 30 days. After that period, your data may be permanently deleted.

Cancellation requests must be submitted to hello@ekewakagenie.com. Pilot cancellations can also be processed instantly from your account settings.

6. Text Message Consent

Ekewaka GENIE offers two distinct points at which you may opt in to receive text messages:

  • When submitting a quote request directly through a contractor's shareable request link, prior to the contractor responding to your request.
  • When accepting a quote sent to you by a contractor via your client portal, after the contractor has generated and sent that quote to you by email.

At either point, checking the SMS consent checkbox constitutes express consent to receive automated text messages related to your quote, appointment scheduling, job status, and related service communications.

This consent is separate and optional from your use of the Service in both cases. Declining SMS consent will not affect your ability to submit a quote request, receive a quote, or work with a contractor — all communications will simply be delivered via email instead.

You may withdraw consent at any time by replying STOP to any text message received. Message and data rates may apply, and message frequency will vary depending on the status of your job or quote. For assistance, reply HELP to any message or contact hello@ekewakagenie.com.

7. AI-Generated Estimates

The Platform uses artificial intelligence to generate property estimates and pricing suggestions. These are provided for informational purposes only and are not binding quotes. Contractors are solely responsible for reviewing, adjusting, and approving all quotes before sending them to clients. The Company makes no warranty regarding the accuracy of AI-generated estimates.

8. Contractor Responsibilities

As a contractor using the Platform, you agree to:

  • Provide accurate business information and maintain an up-to-date profile
  • Review all AI-generated estimates before sending to clients
  • Honor quotes and contracts you send through the Platform
  • Comply with all applicable laws and regulations in your jurisdiction
  • Obtain all necessary licenses and insurance required for your services
  • Not use the Platform for any unlawful purpose

9. Client Data

You are responsible for obtaining appropriate consent from your clients before collecting and processing their personal information through the Platform. You agree to handle client data in compliance with applicable privacy laws.

10. Intellectual Property

The Platform, including its design, features, and content, is owned by Ekewaka GENIE LLC and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Platform.

11. Prohibited Uses

You may not use the Platform to:

  • Violate any applicable law or regulation
  • Transmit spam or unsolicited communications
  • Attempt to gain unauthorized access to any part of the Platform
  • Upload malicious code or interfere with Platform operations
  • Scrape or harvest data from the Platform
  • Impersonate any person or entity

12. Limitation of Liability

To the maximum extent permitted by law, Ekewaka GENIE LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid us in the three months preceding the claim.

13. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind. We do not warrant that the Platform will be uninterrupted, error-free, or that AI-generated estimates will be accurate.

14. Indemnification

You agree to indemnify and hold harmless Ekewaka GENIE LLC and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Georgia.

16. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email. Continued use of the Platform after changes constitutes acceptance of the new Terms.

17. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting hello@ekewakagenie.com.
